Terms of Use

These Terms of Use ("Terms") constitute a legally binding agreement between you and The Aligned Biz Co, LLC ("Company," "we," "us," or "our") governing your access to and use of the SkillPath platform at myskillpath.app (the "Platform"). By creating an account or using the Platform in any way, you confirm that you are at least 18 years of age and agree to be bound by these Terms. If you do not agree, you may not use the Platform.

1. Eligibility

You must be at least 18 years of age to use SkillPath. By using the Platform, you represent and warrant that you meet this requirement and that all information you provide is accurate and complete. We reserve the right to terminate accounts where eligibility requirements are not met.

2. Account Registration and Security

You are responsible for maintaining the confidentiality of your account credentials. You agree to:

• Provide accurate and current information during registration.
• Keep your password secure and not share it with any third party.
• Not share your account login credentials with any other person.
• Notify us immediately at [email protected] if you suspect unauthorized access to your account.

We are not liable for any loss or damage arising from your failure to protect your account credentials.

3. Subscription Plans and Billing

3.1 Free Trial

New users receive a 7-day free trial with limited access to Platform features. No credit card is required to start a trial. At the end of the trial period, access to all features is paused and you will be prompted to select a paid plan. Your data is preserved during and after the trial period.

3.2 Individual Plan

The Individual plan is a one-time payment of $29 USD. It is not a subscription and there are no recurring charges. Access continues indefinitely following payment.

3.3 Professional Plans

Professional plans are offered as monthly or annual subscriptions. You may cancel your subscription at any time. Upon cancellation, your access will remain active through the end of your current billing period, after which your account will be deactivated and your data preserved. Resubscribing at any time restores full access to your existing data.

3.4 Refund Policy

All purchases are final and non-refundable. This applies to both the Individual one-time plan and all Professional subscription plans. By completing a purchase, you acknowledge and agree to this no-refund policy. If you believe a charge was made in error, contact us at [email protected] and we will review your case.

3.5 Price Changes

We reserve the right to modify pricing at any time. Active subscribers will be notified of price changes at least 30 days in advance. Continued use after the effective date of a price change constitutes acceptance of the new pricing.

4. Acceptable Use

You agree to use the Platform only for lawful purposes. You may not:

• Use the Platform to plan, facilitate, or promote any illegal activity or business.
• Resell, sublicense, or redistribute AI-generated outputs from the Platform as a standalone product or service without our prior written consent.
• Share your login credentials with any other person or allow others to access the Platform through your account.
• Scrape, crawl, or otherwise extract data from the Platform through automated means.
• Reverse-engineer, decompile, or attempt to derive the source code, algorithms, or AI models underlying the Platform.
• Use the Platform to build, train, or improve a competing AI-powered business tool or service.
• Submit false, misleading, or fabricated information to manipulate AI outputs.
• Attempt to circumvent tier limitations, trial restrictions, or access controls through any technical or non-technical means.
• Introduce malware, viruses, or any harmful code into the Platform.
• Harass, threaten, or harm other users or our staff.

Violation of these terms may result in immediate account termination without refund.

5. AI-Generated Content

SkillPath uses artificial intelligence to generate business ideas, evaluations, and market analyses based on your inputs. You acknowledge that AI-generated content is provided for informational and exploratory purposes only. It does not constitute legal, financial, investment, or professional business advice. We make no representations or warranties regarding the accuracy, completeness, or fitness for purpose of any AI-generated output. You are solely responsible for any decisions you make based on content generated by the Platform. Please review our Disclaimer for full details.

6. Intellectual Property

All content, features, design, code, trademarks, and materials on the Platform are the property of The Aligned Biz Co, LLC or its licensors and are protected by applicable intellectual property laws.

You retain ownership of the content and information you submit to the Platform. By submitting content, you grant us a non-exclusive, royalty-free license to use, store, and process that content solely to provide the services described in these Terms. We do not claim ownership of your business ideas or personal data.

7. Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.

8. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE ALIGNED BIZ CO, LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING FROM YOUR USE OF OR INABILITY TO USE THE PLATFORM.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM.

9. Indemnification

You agree to indemnify, defend, and hold harmless The Aligned Biz Co, LLC and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

10. Termination

We reserve the right to suspend or terminate your account at any time, with or without notice, for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination will remain in effect.

11. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Wyoming, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in Jackson, Wyoming, in accordance with the rules of the American Arbitration Association. You waive any right to participate in a class action lawsuit or class-wide arbitration.

12. Changes to These Terms

We may update these Terms at any time. When we do, we will revise the "Effective Date" at the top of this page. Material changes will be communicated by email or by a prominent notice on the Platform. Your continued use of SkillPath after any changes constitutes acceptance of the updated Terms.
